Foreword to the Privacy Policy Statement

So here it is, my new web, in good craftsmanship written line by line in HTML by myself, except for the structure of the photo albums contributed by a friend.

It was my intention to create a web that does not collect any data, because I find the modern data collection hype that we are exposed to on the Internet simply exaggerated.

Unfortunately I had to realize that I can't prevent a part of this activity at all, because it is done automatically by the server and, as it seems, no provider offers a deactivation of the recording of certain data (listed below under "Server Log Files").

Furthermore, it's probably a good idea to show a video - unfortunately, "YouTube" and "Vimeo", which I expect to use for this, also collect data from those who watch videos "with them", so this topic was also covered (almost at the bottom), even though at the moment - October 2018 - there is no video yet.

Well, it's a pity that I can't proclaim my web as a "internet-oasis free of cookies and data collection" now, but I don't give up hope to realize this one day.

In the following, a privacy policy statement which should correspond closer to the legal requirements than this foreword.

Privacy Policy Statement

1. Data protection at a glance

General information

The following notes provide a simple overview of what happens to your personal information when you visit our website. Personal information is any information that personally identifies you. For detailed information on the subject of data protection, please refer to our data protection declaration listed below this text.

Data collection on our website

Who is responsible for data collection on this website?

The data processing on this website is carried out by the website operator. Their contact data can be found in the contact-page of this website.

How do we collect your data?

On the one hand, your data is collected by you communicating it to us. This may, for example, involve data that you enter in a contact form.

Other data is automatically collected by our IT systems when you visit the website. These are mainly technical data (e.g. Internet browser, operating system or time of the page call). This data is collected automatically as soon as you enter our website.

What do we use your data for?

Some of the data is collected in order to ensure that the website works correctly. Other data may be used to analyse your user behaviour.

What rights do you have with regard to your data?

You have the right at any time and free of charge to obtain information about the origin, recipient and purpose of your stored personal data. You also have the right to demand the correction, blocking or deletion of this data. You can contact us at any time to the addresss given below ("responsible body") for this and other questions on the subject of data protection. Furthermore, you have the right to appeal to the responsible supervisory authority. In addition, you have the right, under certain circumstances, to demand the restriction of the processing of your personal data. For details, please refer to the data protection declaration under "Right to Restrict Processing".

Analysis tools and third-party tools

When you visit our website, your surfing behaviour can be statistically evaluated. This is done primarily with cookies and so-called analysis programs. The analysis of your surfing behaviour is usually anonymous; the surfing behaviour cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. Detailed information on this can be found in the following privacy statement.

You can object to this analysis. We will inform you about the possibilities of objection in this data protection declaration.

2. General information and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and according to the legal data protection regulations as well as this data protection explanation.

If you use this website, various personal data will be collected. Personal data is data with which you can be personally identified. This data protection declaration explains which data we collect and for what purpose we use it. It also explains how and for what purpose this is done.

We would like to point out that data transmission over the Internet (e.g. communication by e-mail) can be subject to security gaps. A complete protection of the data against access by third parties is not possible.

Reference to the responsible office

The responsible body for data processing on this website is:

Rudolf Michael Schmid
Rauhbühl 3
94234 Viechtach

Phone: 09942/904226
E-mail: rumisoc@gmail.com

Responsible body is the natural or legal person who alone or together with others decides on the purposes and means of processing personal data (e.g. names, e-mail addresses, etc.).

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke any consent you have already given at any time. For this purpose, an informal e-mail notification to us is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 DSGVO)

If data processing is carried out on the basis of Art. 6 para. 1 lit. e or f DSGVO, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which a processing is based can be found in this data protection declaration. If you file an objection, we will no longer process your personal data concerned unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal claims (objection according to Art. 21 para. 1 DSGVO).

If your personal data are processed for the purpose of direct advertising, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is connected with such direct advertising. If you object, your personal data will no longer be used for the purpose of direct advertising (objection according to Art. 21 para. 2 DSGVO).

Right of appeal to the competent supervisory authority

In the event of infringements of the DSGVO, the persons concerned shall have the right to appeal to a supervisory authority, in particular in the Member State of their habitual residence, workplace or place of presumed infringement. The right of appeal shall be without prejudice to other administrative or judicial remedies.

Right to data transferability

You have the right to have data which we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible person, this will only be done as far as it is technically feasible.

Information, blocking, deletion and correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, their origin and recipient and the purpose of data processing and, if applicable, a right to correction, blocking or deletion of this data. You can contact us at any time at the address given before ("responsible body") for this and other questions on the subject of personal data.

Right to limitation of processing

You have the right to demand the restriction of the processing of your personal data. You can contact us at any time at the address given before ("responsible body"). The right to limit the processing exists in the following cases:

If you have restricted the processing of your personal data, these data may only be processed - apart from their storage - with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

3. Data collection on our website

Server Log Files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

These data are not merged with other data sources.

This data is collected on the basis of Art. 6 para. 1 lit. f DSGVO. The website operator has a justified interest in the technically error-free presentation and optimisation of his website - for this purpose the server log files must be recorded.

On my direct inquiry, my provider gave me the following information:

We track visitor activity using Varnish protocols. The Varnish protocol has a very short retention time and is not intended for long-term storage. The Varnish data is sent to us and we process it and send it to two different internal locations:

- Statistics (available through the control panel): Web traffic aggregated by domain, time, country, user agent, etc. and top URLs. There is no opt-out mechanism and no way to disable it. We store this data as long as our customer has an active subscription with us. The storage period is 8 weeks after the end of the subscription.

The IP addresses are only used to determine from which country a visitor comes and are then deleted. Therefore, 'Statistics' does not contain any personal data.

- Access Protocols (available for One.com only): Non-aggregated web protocol with IPs, URLs, query string, user agent, country. We need this data for debugging/troubleshooting. The retention period is 30 days.

It is therefore not an optional function, as we depend on this data to optimize our processes and services. It is therefore not possible to deactivate them. The stored data will not be used for marketing purposes and of course will not be passed on to third parties. For security reasons, no detailed information is provided about internal processes.

Inquiry by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your inquiry including all personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6 Para. 1 lit. b DSGVO if your request is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 para. 1 lit. a DSGVO) and / or on our legitimate interests (Art. 6 para. 1 lit. f DSGVO), as we have a legitimate interest in the effective processing of the enquiries addressed to us.

The data you send us via contact requests will remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular legal retention periods - remain unaffected.

4. Plugins and tools

YouTube with enhanced data protection

Our website uses plugins from the YouTube website. The site is operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.

We use YouTube in advanced privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they view the video. However, YouTube's enhanced privacy mode does not necessarily preclude YouTube from sharing information with its partners. YouTube connects to the Google DoubleClick network regardless of whether you're watching a video or not.

As soon as you start a YouTube video on our website, a connection to YouTube's servers is established. This will tell the YouTube server which of our pages you've visited. If you are logged in to your YouTube account, you can allow YouTube to associate your surfing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.

In addition, YouTube can store various cookies on your terminal device after starting a video. YouTube can use these cookies to obtain information about visitors to our website. This information is used, among other things, to collect video statistics, improve usability and prevent fraud attempts. The cookies remain on your terminal until you delete them.

If necessary, after the start of a YouTube video, further data processing operations may be triggered over which we have no control.

YouTube is used in the interest of an appealing presentation of our online services. This constitutes a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO.

For more information about privacy at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de .

Vimeo

Our website uses plugins of the video portal Vimeo. The provider is Vimeo Inc, 555 West 18th Street, New York, New York 10011, USA.

When you visit one of our pages equipped with a Vimeo plug-in, a connection is established to the Vimeo servers. This will tell the Vimeo server which of our pages you have visited. In addition, Vimeo obtains your IP address. This also applies if you are not logged in to Vimeo or do not have an account with Vimeo. The information collected by Vimeo is transferred to the Vimeo server in the USA.

If you are logged in to your Vimeo account, you enable Vimeo to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your Vimeo account.

The use of Vimeo takes place in the interest of an appealing representation of our on-line offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

Further information on the handling of user data can be found in Vimeo's data protection declaration: https://vimeo.com/privacy .
